Biermann, 40, has filed a new custody request, according to a Thursday, April 23 report on TMZ. The former professional football player is seeking permanent physical and legal custody of their four minor children: Kroy “KJ” Jr., 14, Kash, 13, and twins Kaia and Kane, 12.
Under their current agreement, Biermann and the former Real Housewives of Atlanta star split time with two children each — an arrangement he claims is not sustainable. “The children were rarely together as a group under this parenting plan,” Kroy said, according to the outlet.
The retired NFL athlete also alleged that Zolciak, 47, “acts in ways that are harmful to the children and contrary to their best interests.”
Earlier this month, In Touch reported that Zolciak lost custody of her children until she completed court-ordered therapy sessions. According to TMZ, Biermann said Zolciak had only completed four over a seven-day period.
In court documents, Biermann described Zolciak as “both unstable and fit” as a parent, adding that she is “more selfishly concerned with her own image and work options than with the opinions of experts and/or the best interests of the children.”

“This constitutes neglect of the minor children and is harmful to the progress and healing of the family unit,” his allegations continued.
Zolciak’s attorney denied the claims, telling In Touch via a statement that Biermann’s “decision to file this motion lacks factual support and is unwarranted.”
“We will address these claims in the proper legal forum and will vigorously defend the truth in court, rather than through public discourse,” the attorney added.
In addition to their four minor children, Zolciak shares daughters Brielle, 28, and Ariana, 23 from previous relationships. Biermann legally adopted both in 2013.
