Laura Prepon Submits Bombshell Witness Affidavits After Ex Ben Foster Denies Alcohol Abuse

Laura Prepon filed bombshell witness declarations to back up her claims her estranged husband, Ben Foster, has had issues with drinking after he denied the allegations, In Touch can exclusively report.

According to court documents obtained by In Touch, Ben, 44, fired back at Laura’s recent claims in court. In a newly filed document, Ben’s lawyer, Rose Palermo, said the actor had “deep sadness” being forced to reply to the allegations in Laura’s court filing.

He accused Laura, 44, of exercising “total control” over their children since the divorce.

Ben said he has not had more than a four-hour block with the kids.

“Beyond that, [Laura] has refused to allow [Ben] to have any meaningful parenting time with the children or even discuss this matter with him beyond her specified terms, nor has she ever allowed [Ben] to have any overnight parenting time to date,” Ben’s lawyer wrote.

His lawyer accused Laura of launching a “punitive, unsupported attack” on Ben by using the “children as pawns to hurt him.”

Ben claimed he is focused on the best interests of their children. He pointed to a book she wrote that talked about her drinking, mental thought processes and her “generational eating disorder.”

Ben denied that he was not a present parent with his children. He also denied that he had a longstanding drinking problem.

He said he “vigorously denies [Laura’s] allegations, mischaracterizations and narrative about his drinking. He said he has been a social drinker since adulthood but never has been accused of public intoxication or been arrested for a DUI. he said he has never endangered the children due to drinking. Ben’s lawyer said, “ironically, if anything, [Laura] is well-known for enjoying her drinks — day and night.

She teaches cocktail-making on her social media, promotes her drinking here and often refers to herself as a “wine mommy.”

Laura mentioned one example in her filing where she found Ben drunk outside their door. Ben said that he had just returned home from shooting a film where he was a concentration camp victim in Auschwitz.

He said he went outside to get some air and then came back to a locked door. He said he did not knock because he didn’t want to wake Laura but he claims he not drunk. Ben also accused her of having “extreme and aggressive mood swings.”

Laura’s powerhouse lawyer, Larry Hayes, quickly fired back in court by submitting witness affidavits.

One of Laura’s employees named Laura Vogel, who has worked for the actress for seven years, said she observed both parties. She said Laura has “always been the children’s full-time primary caretaker.”

She said, “in stark contrast, over the past seven years, Ben has shown, predominately through inaction and absence, that being a father is not Ben’s priority. Sadly, Ben has never prioritized caring for the parties’ children.” She added, “when I have been around Laura handling parenting responsibilities, sometimes Ben would ‘pop in’ but rarely, if ever actually assisted with the children’s care. When Ben did ‘pop in’ he would often be drinking alcohol.” She added that she saw Ben having shaky hands and adding alcohol into his coffee during a trip to Palm Springs in 2022.

She said she witnessed Ben drinking throughout the day and into the late evening.

Another affidavit was filed by the couple’s nanny who has worked for them since February.

The employee named Emily Neikman claimed Ben had “little to no involvement” in her hiring. She said Ben’s time with the kids over the past 10 months has been “sporadic.”

She added, “A more serious concern that I have about Ben’s ability to care for these children relates to his consumption of alcohol around the children. It is my opinion that Ben has an issue with alcohol that needs to be addressed. I have frequently found whiskey in coffee cups that Ben leaves in the children’s rooms.”

She said she smelled liquor on Ben during time with the children. A judge has yet to rule on the matter.

As In Touch previously reported, Ben filed for divorce from Laura in September. He listed the date of separation as September 9.

Ben and Laura wed on May 25, 2018. The exes share two children, a daughter named Ella and a second child whose name they have not revealed.

As In Touch first reported, Ben asked the court to set a custody schedule after he claimed attempts to work out a temporary deal with Laura were “unsuccessful.” Laura filed a bombshell filing in response.

She claimed to have been the primary caretaker of the two kids since their birth. She claimed that Ben had barely been around for the past couple of months and rarely spent time alone with the kids.

Laura said Ben left to shoot a movie in August but did not return home until September.

“During this span of over one hundred days, [Ben] visited the minor children in Tennessee approximately four times — never overnight — and FaceTimed the minor children approximately eleven times.” Her lawyer added, “These limited visits were short in duration — mostly consisting of dinner visits. Even when offered to extend the visits, [Ben] often declined.”

On top of that, Laura claimed Ben had a history of alcohol abuse. She asked the court to order Ben not to drink 12 hours before or during his time with the kids.

After Laura’s motion was filed, Ben’s attorney told In Touch, “Laura Prepon’s filing is the definition of falsehood and a disturbing fiction.”
