Laura Prepon Claims Ben Foster Spent ‘Inordinate’ Amount of Time With Female Costar Before Divorce

Laura Prepon accused her estranged husband, Ben Foster, of seeing their kids four times in the span of months and spending excessive amounts of time with his female costar before their split, In Touch can exclusively report.

According to court documents obtained by In Touch, Laura, 44, fired back at Ben’s request for the court to set a temporary custody schedule in their bitter divorce.

Ben, 44, claimed he had attempted to reach an agreement with Laura, but said his efforts had been “unsuccessful.” In the actress’ response, filed by her lawyer Larry Hayes, Laura slammed Ben, claiming he had a history of alcohol abuse that concerned her.

She asked that the court order him to not drink 12 hours before or during a custody visit with their children.

In the alternative, Laura asked that a supervisor be present for Ben’s parenting time. In her filing, Laura explained that she and Ben had lived separately while Ben was away filming for the past four months. She said Ben finished filming the movie in the last week of August but did not return home to see his children even though he had not seen them in almost four weeks.

“Instead, despite his statements to [Laura] that he would not be going to the Venice Film Festival, [Ben] nonetheless was spotted in Italy on the red carpet posing without his wedding ring on,” the filing claimed.

Laura said Ben returned home on September 9. In his divorce petition, Ben listed September 9 as the date of separation.

He asked to see the kids without her present. She said he packed his bags and left the kids with the nanny as he departed their marital home.

Laura believes Ben’s request to see their kids was a “ruse to enable him to file for divorce and remove his belongings without [Laura] knowing.” In her filing, Laura said Ben got a new place to live but she fears it is not childproofed. On top of that, she laid out several alleged examples of Ben’s alleged “longstanding history of alcohol abuse.”

Laura accused Ben of day drinking, using thermos to drink whiskey and coffee, throwing up in their bathroom sink because he couldn’t make it to the toilet one time and having shaky hands in the morning.

The actress said Ben’s drinking became such an issue they had to establish rules.

She said Ben agreed not to drink alcohol in their bedroom and to not turn on the stove while making late night snacks “as a safety precaution.” Laura pointed out that Ben left to film his movie in July.

She said four months later, in November, he returned. “During this span of over one hundred days, [Ben] visited the minor children in Tennessee approximately four times — never overnight — and FaceTimed the minor children approximately eleven times.”

Her lawyer added, “These limited visits were short in duration — mostly consisting of dinner visits. Even when offered to extend the visits, [Ben] often declined.”

Laura said she has been the primary caretaker for their two children since they were born. In her filing, she said that she has attended all of their childrens’ school events and doctor’s appointments. She said Ben has not attended a single event or appointment. Laura said in August she attended both childrens’ school orientations, which she claimed Ben never asked about. She said she made sure their kids were prepared for their school year without any help from Ben.

“During this time, [Ben] was filming out-of-state but also socializing afterhours with his costars, one of whom in particular is female and seemed to be spending an inordinate amount of time with [Ben],” Laura claimed.

Laura asked that the court consider all of the factors in her motion before entering a temporary custody schedule.

Ben’s attorney, Rose Palermo, tells In Touch, “Laura Prepon’s filing is the definition of falsehood and a disturbing fiction.”

As In Touch first reported, Ben filed for divorce in September. Ben and Laura wed on May 25, 2018. The exes share two children, a daughter named Ella and a second child whose name they have not revealed.

Laura was seen recently on Netflix’s That 90’s Show, which is a spinoff of That 70’s show, where she returned as her character Donna Pinciotti.
