’90 Day Fiancé’ Star Jay Smith Is in ICE Custody and Facing Deportation

90 Day Fiancé star Jay Smith (real name: Conroy St. Christopher Smith) is currently in ICE custody and is facing deportation, In Touch can exclusively confirm. The 21-year-old Jamaica native turned himself into authorities upon learning he had a warrant out for his arrest, a source explains, stemming from an alleged violation of a PFA (Protection From Abuse) order that was placed against him by his estranged wife, Ashley Smith (née Martson), on Monday, July 1.

According to ICE records obtained by In Touch, Jay is being detained in York County Prison in Pennsylvania. Hours before he was detained, Jay posted a video clip to his Instagram Story with cryptic lyrics about someone “turning” themselves in.

On July 3, 90 Day Fiancé blogger John Yates reposted a screenshot of a statement from Ashley, 31, that was shared and then quickly deleted. “Mark my words this is the hardest day of my life. I can’t believe this is how it ended. The amount of sadness I’m feeling is unfathomable. There is no celebrating over here, just pure heartbreak!” Ashley wrote in a message via Instagram Stories.

Since Jay is not a United States citizen, he was placed in ICE custody. The tattoo artist moved his native country of Jamaica to Ashley’s hometown of Mechanicsburg, Pennsylvania, in 2018. He was legally able to enter America under the K-1 visa, which is also known as the fiancé because it allows the foreign fiancé of an American citizen to enter the country under the condition that the couple will get married within 90 days.

If the couple gets married within the 90 days, the foreigner is eligible for an adjustment of status and would eventually be issued a green card, which would allow them to remain in the United States legally. Jay and Ashley got married within the 90 days of his arrival in the States, but since she did not file his adjustment of status, he is facing the possibility of being deported back to Jamaica. If Jay is deported, this would mark the first time that a 90 Day Fiancé star has been in ICE custody since the franchise’s 2014 premiere.
