He's crying foul! Last month, disgraced former Subway spokesperson Jared Fogle filed a petition for early release after serving less than two years out of his 15-year prison sentence for child pornography, but he was quickly denied. Now he wants the judge who presided over his case to be removed because he felt she is unfairly prejudiced against him because she is a mother of two teenage daughters.

According to legal documents obtained by TMZ, Jared wants Judge Tanya Walton Pratt to be recused because his case involved alleged sex a teenage prostitute and teenage girls who were illegally photographed. Jared had more than 47,000 sexual images on his computer of young girls and he also had sex with two underage girls, and he felt that because of that, Judge Pratt is biased because she is also a mother of two young girls.

In Jared's filing, he tried to use the fact that he was wrongfully charged with conspiracy as a means to throw out his sentence entirely. “The court failed to address the Notation of ‘conspiracy’ and the contention of such,” Fogle wrote himself at the prison library, according to Radar Online. “The statute…clearly offers no provision for charging a party with ‘conspiracy.'”

He also claimed that he was wrongfully charged with “four counts of travel in foreign commerce for the purpose of engaging in illicit sexual conduct with a minor" because he never traveled out of the state in order to engage in sexual acts with a child, even though he had originally plead guilty to the possession and distribution of child porn, and to traveling across state lines to engaged in sex with at least two teenage girls, according to CNN.

“Fogle again challenges the Court’s subject matter jurisdiction over him and requests immediate release from detention,” Judge Pratt wrote in the court document, according to the New York Daily News. “The Motion, Notices, and Objection are all DENIED.”
