Halle Berry’s Ex Olivier Accuses Her of Believing She Can ‘Violate’ Rules Due to Her Wealth

Halle Berrys ex-husband, Olivier Martinez, slammed the actress’ attempt to have a judge reconsider the order requiring her to pay sanctions, In Touch can exclusively report.

According to court documents obtained by In Touch, Olivier, 58, asked that Halle’s objection to the tentative decision reached by the judge on October 28 be denied. Halle, 58, and Olivier have been going back and forth in court for months.

The exes settled their never-ending divorce in 2023. They agreed to share joint legal and physical custody of their 11-year-old son, Maceo.

A couple of months after the deal was executed, Halle went back to court accusing Olivier of not complying with the terms of their agreement. She asked the court to award her sole legal custody of Maceo.

Olivier objected to the request. He asked the court to award him $360,000 to help pay lawyers to continue fighting Halle in court. Halle scoffed at the suggestion. She asked the court to award her $455,000 in sanctions against Olivier.

At a recent hearing, the judge said he believes Halle should pay Olivier $271,052 in legal fees and another $6,015 in sanctions.

The judge said he believed Olivier should pay Halle sanctions in the amount of $60,000. The ruling said Halle would pay a total of $217,714 after the sanctions owed by Olivier were deducted.

A couple of weeks later, Halle’s lawyer filed a motion to have the sanctions the actress was ordered to pay reversed.

Halle’s lawyer said, “The Court’s ruling on sanctions against Halle in the sum of $6,015 violates Halle’s due process rights and is prohibited as a matter of law. Furthermore, the Court made factual findings that were incomplete, inconsistent with, or contrary to the evidence presented.”

Halle is also challenging certain findings of fact that make up the amounts at issue. In his recent motion, Olivier asked that the decision to award him sanctions not be vacated by the court. Olivier said Halle should pay the sanctions due to her “lack of civility and cooperation in communications through counsel, her refusal to engage in meaningful settlement discussions and/or to withdraw baseless ex parte applications and other examples where [Halle] repeatedly took the path of most resistance, causing the parties to incur unnecessary attorney fees.”

The actor pointed out Halle has “millions of dollars in assets and incomes” which allows her to make “baseless” claims in court.

He said he has “essentially no funds, other than what [Halle] pays, to defend this unnecessary and inaccurate claim.”

Olivier claimed that “with the exception of one” post-settlement mediation, Halle has “refused to engage in any further mediations to settle out of court, in Maceo’s best interest.”

He said she threatened to file for a custody evaluation.

His lawyer continued, “Halle’s position is that the Court cannot sanction her under Family Code Section 271 because she is so extraordinarily wealthy and is paying all reasonable fees so she can violate Family Code Section 271 whenever she pleases. There is no case law that would permit or condone such behavior and in fact all case law is in contravention of such a position. The very purpose of Family Code Section 271 is to deter such behavior and to encourage parties to cooperate and minimize litigation.”

Olivier’s lawyer added, ‘It is unfortunate that Halle’s objection to the Court’s conservative sanctions award against her makes clear that she has no incentive in the future to engage cooperatively because apparently she believes she can never be sanctioned.”

The judge has yet to issue a final order on the sanctions.

As In Touch first reported, Halle’s boyfriend, Van Hunt, was dragged into the legal battle this week.
