Halle Berry will be calling her boyfriend, Van Hunt, to testify in her custody battle with her ex-husband Olivier Martinez — while Olivier plans to call the actress’ former longtime employee to the stand, In Touch can exclusively report.

According to court documents obtained by In Touch, Halle, 58, submitted her witness list weeks before she’s scheduled to face off with Olivier, 58.

Halle said she will be taking the stand to testify about her issues with Olivier’s coparenting and her belief that he is interfering with their son Maceo’s growth.

The actress said she will call Olivier to grill him about her claims.

Halle said she will then call Van, 54. She said Van will answer questions for about 30 minutes and will talk about his communications with Olivier, “efforts to promote coparenting between the parties and his observations regarding [Halle’s] efforts to coparent with [Olivier].”

Halle will also be calling a woman named Erica, who she said will tell the court about Olivier’s attempts to “interfere with Maceo’s therapeutic process and Maceo’s relationship with [Halle].”

Olivier submitted his own witness list. He said he will be grilling Halle for two hours and then he will testify himself.

The actor said he will also call a woman named Miryam.

He said Miryam worked for Halle for 20 years until October 2024.

He said Miryam plans to testify about her “observations of Maceo in [Halle’s] care and Maceo’s interactions with [Halle], as well as her interactions and communications with [Halle] as it relates to the minor child, this [divorce] and custody proceeding.”

As In Touch previously reported, Halle and Olivier split in 2015. They share a 11-year-old son named Maceo. The exes settled their bitter divorce in late 2023.

The agreement said the duo should share joint legal and physical custody of their son.

Halle agreed to pay $8,000 a month in child support. In addition, Halle and Olivier agreed to participate in coparenting therapy session.

Olivier had a provision added that Halle’s boyfriend could not participate in the sessions.

In August, Halle accused Olivier of skipping out on the therapy sessions, despite the agreement.

She also claimed he conspired with one of her former employees in an attempt to influence their son’s therapist. The actress said she sued the ex-employee for violating the terms of her contract.

Halle asked the court to award her sole legal custody of their son. She said it would be in the best interest if she was allowed to make decisions about Maceo’s education and health without Olivier.

“Olivier has refused to coparent and communicate with me in a child-centered way; he has been oppositional and unmovable on all major issues relating to Maceo,” Halle told the court.

“Olivier made unilateral decisions relating to physical custody, extracurricular activities, tutoring, therapy, travel, and has withheld critical information from me despite specific court orders obligating him to provide me with information,” she said.

Halle also accused Olivier of refusing to accept her relationship with Van, “who plays an important role in Maceo’s life.”

She said, “Olivier’s lack of acceptance of Van has resulted in Olivier refusing to permit Maceo to work in a family therapy setting with me and Van as a means to continue to create a healthy environment for our son within the structure of a blended family.”

Olivier opposed the request to strip him of legal custody. The actor accused Halle of using her wealth to drag him in and out of court.

Olivier said he had to sell a Rolex and take out a loan to pay his divorce lawyer a $55,000 lump sum to work on the case. The exes are preparing to face off at a hearing next month.

As In Touch first reported, the exes have been going back and forth about Olivier’s legal fees.

Olivier asked the court to order Halle to pay him $360,000 so he could continue to fight her in court.

Halle, who called Olivier “willingly unemployed” in the court battle, opposed paying her ex additional fees for his lawyers. She asked that Olivier be sanctioned to the tune of $455,509.79 for his actions that she believed caused the case to drag on.

Halle’s lawyer argued, “Halle should not be forced to pay for Olivier’s unreasonable conduct when he is the sole reason why the fees and costs have escalated in this case.”

At a recent hearing, the judge issued a tentative ruling on the matter of attorney fees. The judge said he believes Halle should pay Olivier $271,052 in legal fees and $6,015 in sanctions. The judge also ruled that Olivier should pay Halle sanctions in the amount of $59,893.

The court said the amount Halle will pay Olivier after deducting the fees she was awarded comes to $217,174. Halle filed a motion to oppose the tentative ruling to award Olivier sanctions. The case is ongoing.
