Shelley Duvall’s Family Suffers Tragedy Amid Fight With Late Actress’ Partner Over Estate

One of Shelley Duvall’s three brothers passed away amid the family’s court battle with the late actress’ longtime partner, In Touch can exclusively report.

According to court documents obtained by In Touch, Shelley’s brother Scott Duvall passed away on November 18 in Texas.

The development comes as Shelley’s two other brothers, Stewart and Shane Duvall, duke it out with Shelley’s partner, Dan Gilroy. Shelley died on July 1 at the age of 75.

The actress passed away in her home in Blanco, Texas. Dan filed a petition to be named administrator of Shelley’s estate shortly after her death.

In his filing, Dan told the court that he had a “common law” marriage with Shelley. Shelley and Dan were together for 35 years.

Dan said that he would prove that he had an agreement with the late entertainer to be married and “demonstrated an intention to create a present, immediate, and permanent marital relationship.”

Dan told the court that he lived with Shelley in Texas and that they represented themselves as “husband and wife” to others.

In his petition, Dan asked the court to award him 100 percent of community real property, 50 percent of separate real property and 100 percent of community and separate personal property.

His filing proposed that Shelley’s brothers be awarded a 1/6th interest in the separate real property.

Shane objected to Dan’s petition. He said the beneficiaries to Shelley’s estate were her three brothers. Shane told the court that Dan had no interest in Shelley’s property.

Shane filed his own petition to be named administrator of the estate. Stewart filed his own paperwork asking to be named temporary administrator. He said he would be on board with them serving as coadministrators.

In paperwork, Stewart revealed the assets that Shelley left behind. He said that Shelley had $50,000 in the bank, she owned her Texas home worth around $600,000, had various personal property and received minor royalty payments.

Dan and the two remaining brothers are still fighting ahead of the upcoming hearing.

Stewart recently fired off subpoenas to accountants demanding they turn over records pertaining to Shelley and Dan from January 1995 to present.

Stewart notified Dan that he sent the subpoenas and that he intended to depose representatives from the accounting firms. Shelley’s brother appears to believe the accounting records could help his case against Dan as they fight over who will control Shelley’s estate. Dan has yet to respond to the notice in court.

After Shelley’s death, Dan told The Hollywood Reporter, “My dear, sweet, wonderful life partner and friend left us. Too much suffering lately, now she’s free. Fly away, beautiful Shelley.”

Shelley, who starred in Stanley Kubrick’s The Shining, was honored by the late director’s Twitter account after her passing.

“Shelley’s career was varied and long. Despite being dogged with exaggerations of her treatment on set, Shelley was always vocal about her experience filming The Shining saying she ‘wouldn’t trade it for anything’ because ‘working with loveable Stanley was a fascinating learning experience.’ Our thoughts are with Shelley’s friends and family,” Stanley’s team wrote.
