Prosecutors Demand 90 Day Fiance’s Michael Eloshway Serve 20 Years in Prison and Pay Victims

Prosecutors are asking a federal judge to throw 90 Day Fiancé‘s Michael Eloshway behind bars for two decades and for restitution for the victims, In Touch can exclusively report.

According to court documents obtained by In Touch, prosecutors argued for the book to be thrown at the ex-TLC star ahead of his sentencing later this month. The prosecutors said Michael should serve 17.5 to 20 years in prison.

As In Touch previously reported, Michael was found guilty on two charges of child pornography in July. He was found to have received, distributed and possessed videos that prosecutors described as “sadistic.”

Michael’s lawyer argued that his client’s internet searches were “generic.” He said the reality star deleted any material that he downloaded that he believed to be illegal.

In the prosecutors’ motion, they explained that Michael was first brought to the attention of law enforcement when his IP address was pinged by undercover law enforcement.

Between February 2022 and March 2023, Michael allegedly transmitted over 63,000 files. “Of the files shared and downloaded, approximately 4,517 contained sadism and masochism.”

Michael sent five video files and 57 images to an undercover officer. “These files included sadistic content and depicted the rape of victims as young as a year old,” the government wrote.

The government said a federal search warrant was executed at Michael’s home on May 9, 2023. Law enforcement seized Michael’s desktop computer.

Michael was voluntarily interviewed and admitted to sharing files online for approximately 20 years, the filing said. Michael maintained his innocence but admitted searching for explicit “teen” videos.

The prosecutors said the children in the videos “often live with the knowledge that there are numerous, unknown individuals in the world who are sexually gratifying themselves with pictures of the worst moments of the children’s lives and that such exploitation will continue indefinitely.”

The prosecutors described Michael as “more than just a casual observer who happened to download [illegal videos] when seeking legal pornography.”

The government said Michael admitted to deleting illegal images after viewing them, “although he did not delete the seven thousand found on his desktop.” They added, “He has not accepted responsibility for violating federal law or the exploitation of the children whose images he possessed.”

Prosecutors said Michael grew up in Ohio in a “normal” household with little-to-no exposure to violence or drugs.

The government argued, “Even though [Michael] and others who have an overwhelming interest in the sexual assault of young children may not be deterred even if the sentence for the crimes was life, it is also true that others would certainly not be deterred if [Michael] received a below guideline sentence.”

The prosecutors continued, “These offenders do talk to each other via the Internet, and they are concerned enough about law enforcement that they encrypt their hard drives, seek foreign websites, and use anonymous phone apps in an effort to prevent detection. There is much to be gained by a significant sentence— increased safety for our children.”

On top of the 20-year sentence, the government asked that Michael pay $10,000 in fines and at least $3,000 to two victims that were featured on the videos. The filing explained, “The National Center for Missing and Exploited Children (NCMEC) identified ten image files and three video files from [Michael’s] collection that depicted children previously identified by law enforcement. These identified images came from 12 separate series. Of those, two victims have submitted requests for restitution in [Michael’s] case.”

Michael has yet to respond. He has been allowed to remain out on bond until sentencing.
