Diddy accused the male prisoner suing him over an alleged sexual assault of forging evidence in the case, In Touch can exclusively report.
According to court documents obtained by In Touch, Diddy, 55, and his legal team fired back at recent claims by Derrick Lee Cardello-Smith.
Derrick, who sued Diddy over an alleged 1997 assault, claimed the musician and his team were conspiring with state court officials to interfere with his filings in the case.
Derrick provided an alleged document that he said was a note from a court clerk instructing staff to delay filing one of his motions.
Diddy and his team scoffed at the claims. His lawyer wrote, “Once again, [Derrick] seeks to persuade this Court that he is the subject of an ever-growing conspiracy to frame him and cover up an alleged assault. Now, the conspiracy includes clerks of the Lenawee County Circuit Court, who, Plaintiff alleges, conspired with the undersigned counsel to delay the filing of Plaintiff’s Motion for Reconsideration. Like virtually all of Plaintiff’s filings, this Motion is based on an obvious fabrication — a forged ‘note’ supposedly written by the Lenawee County Circuit Court clerk.”

They added, “In a telephone call with [Diddy’s] counsel, the Lenawee County Circuit Court clerk confirmed that both the supposed ‘note’ and the ‘filed’ date stamps appended to [Derrick’s] Motion were not placed on the documents by the clerk’s office. Once again, the only logical inference is that [Derrick] entirely implausible allegations are based upon a forged ‘note’ and forged ‘filed’ date stamps.”
Diddy’s lawyer added, “Even accepting Plaintiff’s obvious fabrication at face value, the filing date of the Motion for Reconsideration is irrelevant to this Court’s jurisdiction.”
Diddy asked that Derrick’s motion for an emergency hearing be shut down and he be awarded sanctions against the prisoner.
Last year, Derrick sued Diddy over an alleged assault in 1997 at a Holiday Inn in Detroit. Derrick said he met the mogul while bartending.

He said Diddy invited him to a sex party at the hotel, which he attended. Derrick claimed Diddy gave him a drink at the party and told him he added “a little something” to it. The man said he fell asleep and woke up to Diddy having sexual relations with a woman. In his suit, Derrick claimed Diddy looked at him and told him, “I did this to you too!” Derrick claimed Diddy and government officials conspired together to cover up crimes. Diddy denied all allegations of wrongdoing.
His lawyers accused Derrick of bringing “baseless” claims. Further, they claimed that Derrick said the alleged assault occurred at two different locations in two different complaints he filed.
“Incredibly, in two different complaints filed in two different courts, [Derrick] alleges that this purported assault occurred in two different counties on the same day,” his lawyer said.
On top of that, Diddy argued the claims were filed way past the statute of limitations.
As In Touch first reported, Derrick revealed in recent court documents that he plans to call Diddy’s ex Jennifer Lopez as a witness in the case.

He believes she may have information relevant to the case due to her dating Diddy in the years after the alleged assault. Diddy’s lawyer asked the court to stop Derrick from submitting new filings.
They argued, “[Derrick] has filed several, substantially identical lawsuits against [Diddy], in each case demanding enormous sums of money based on wholesale fabrications.”
They added, “His frequent filings clearly indicate he has no intention of stopping his meritless attacks. As a result of [Derrick’s] harassment, [Diddy] has incurred significant legal fees and costs. [Derrick’s] barrage of meritless, fraudulent filings must come to an end.”
Diddy’s attorney added, “This is not [Derrick’s] first attempt at a shakedown — and unless this Court intervenes, it will not be his last. [Derrick] has a lengthy history of filing frivolous lawsuits in this District and beyond.”
Diddy’s lawyer previously said about the lawsuit, “This man is a convicted felon and sexual predator who has been sentenced on 14 counts of sexual assault and kidnapping over the last 26 years. His resume now includes committing a fraud on the court from prison, as Mr. Combs has never heard of him let alone been served with any lawsuit.”
