Less than two weeks after disgraced actor and comedian Bill Cosby was sentenced to serve three to 10 years in state prison for three felony sex assault counts, his lawyers are hoping to overturn his conviction and sentence. According to a new report by the Associated Press, the lawyers are citing a “string of trial errors” is the reason why they think the conviction and sentence should be overturned.

In a motion, Bill’s defense team claims that Judge Steven O’Neil, who presided over the case, should not have declared Bill a “sexually violent predator,” and they felt that Bill’s three to 10-year prison sentence was too harsh considering the fact that two to three years is standard and Bill is currently 81 years old and blind.

Another major reason why the defense wants the sentence overturned is because the evidence that was presented during the trial never proved if the incident involving Bill’s alleged sexual assault took place in 2003 or 2004, or if Bill had been arrested for the alleged crime within the 12-year limit.

Since his sentencing on Sept. 25, Bill has been in custody at a state prison near Philadelphia. Prosecutors for Montgomery County said they will file a response to the motion to overturn Bill’s sentence and conviction.

Just hours after Bill was sentenced and taken into custody, his spokesperson Andrew Wyatt released a statement on his behalf.

“Mr. Cosby is doing great,” the statement read. “And Mr. Cosby knows that God is watching over him. He knows that these are lies. They persecuted Jesus and looked what happened. Not saying Mr. Cosby is Jesus. But we know what this country has done to black men for centuries. So Mr. Cosby is doing fine. He is holding up well. And everybody who wants to say anything negative, you’re a joke as well.”
